By accessing or using PakBirds, you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.

1. Eligibility

You must be at least 18 years old and able to form a legally binding contract to create an account or transact on PakBirds.

2. Listings

Sellers are solely responsible for the accuracy of their listings, including price, breed, health, and pedigree claims. All listings are subject to admin review before going live.

3. Wildlife Law & Prohibited Species ⚠️

The bird trade in Pakistan is regulated by provincial wildlife law (including the Punjab Wildlife Act, Sindh Wildlife Protection Ordinance, Khyber Pakhtunkhwa Wildlife Act, and equivalent rules elsewhere). Trapping, keeping, breeding, or selling many native wild bird species — including birds of prey, owls, wild-caught parakeets and native partridge/quail species — is banned or requires a specific provincial license. Some provinces also require dealers, breeders, and even pet owners to hold a license or registration.

By posting a listing, you represent and warrant that:

• The bird is not a protected or wild-caught species prohibited under applicable wildlife law.
• You hold any license, permit, or registration required to legally trade this bird in your province.
• You will provide proof of legal ownership/licensing to PakBirds or the relevant wildlife authority if requested.

Listing a prohibited, protected, or illegally-traded species is strictly forbidden and will result in immediate removal and possible account suspension or ban. Full details, examples, and provincial contacts are in our Wildlife Law & Prohibited Species Policy.

4. Transactions

PakBirds is a platform that connects buyers and sellers — we are not a party to any transaction between them and do not guarantee the condition, health, or authenticity of any bird listed. Always inspect a bird in person and verify the seller before making payment.

5. Accounts & Verification

You must provide accurate registration information and keep your phone number verified. New accounts require admin approval. We may suspend or terminate accounts for fraud, spam, abuse, or violation of these Terms.

6. Fees

Posting a standard listing is free. Optional paid features, such as featured/boosted listings, are charged as shown at checkout and are non-refundable once activated, except where required by law.

7. PakBirds Delivery

PakBirds Delivery (rider pickup and cargo shipping) is offered as a convenience between buyers and sellers. Delivery times and fees shown are estimates and may vary due to distance, availability, or circumstances beyond our control.

8. Prohibited Conduct

• Posting false, misleading, or duplicate listings.
• Abusive, threatening, hateful, or vulgar language towards any member.
• Harassing, spamming, or scamming other users.
• Fraud, fake payments, or any attempt to cheat another member.
• Listing species protected by Pakistani wildlife law or international trade restrictions (see Section 3).
• Attempting to circumvent our verification, messaging, or payment systems.

9. Suspension & Permanent Blocking

If you are reported for abusive behaviour, fraud, or a scam, we may suspend your account immediately while we investigate. If the matter is not resolved, or in cases of serious or repeated misuse, your account may be permanently blocked. Permanently blocked users are not permitted to register a new account using the same email address or phone number. These decisions are made at our sole discretion to protect the community.

10. Limitation of Liability

PakBirds is provided "as is". To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the platform or any transaction with another user.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of PakBirds after changes are posted constitutes acceptance of the revised Terms.

12. Content, Photos & Copyright

Listings, photos, videos and descriptions on PakBirds are uploaded by the users who create them — not by PakBirds. PakBirds is a neutral classified-listings platform and does not create, own, endorse, or independently verify user-uploaded content.

By uploading any content, you represent and warrant that you own it or have the necessary rights and permission to use it, and that it does not infringe any third party's copyright, trademark, privacy, publicity, or other rights. You grant PakBirds a non-exclusive, worldwide, royalty-free licence to host, store, resize, display and distribute that content for the purpose of operating, improving and promoting the platform.

You are solely responsible for the content you upload, and you agree to indemnify and hold PakBirds harmless from any claim, loss or demand — including copyright or other intellectual-property claims — arising out of content you upload.

Copyright complaints — notice & takedown

We respect intellectual-property rights and act on valid complaints. If you believe content on PakBirds infringes your copyright or other rights, please send us: (1) the listing URL or the specific image/video, (2) a description and evidence of the right you own, and (3) your name and contact details. On receipt of a valid notice we will review and, where appropriate, promptly remove or disable access to the content, and may notify or act against the user who uploaded it.
